Anti-circumvention
Anti-circumvention: measures by governments to prevent circumvention of measures they have imposed, such as definitive anti- dumping duties. Sometimes firms seek to avoid such duties through, for example, assembly of parts and components either in the importing country or a third country, or by shifting the source of manufacture and export to a third country. The term as used in the WTO does not refer to cases of fraud. These would be dealt with under normal legal procedures of the countries concerned. The Agreement on Agriculture contains an anti- circumvention provision. It stipulates that export subsidies not listed in the Agreement must not be used to circumvent export subsidy commitments.
